General Terms of Use
All WinksArt Graphics designs, fonts, and specifically designed program presets such as actions and styles (all hereafter referred to as Graphic[s]) are protected by United States and International Copyright Laws.
Using, copying, or allowing the copying or sharing of these graphics for another's personal use or for any commercial use is prohibited. Graphics that may be shared, used without purchase, or used for commercial purposes are noted as such either on this website or in the TOU provided in each design, graphic, or kit file.
Changing any Graphic[s] in any way is prohibited, with the exception of resizing or cropping for an individual project. Graphics that may be re-colored or have color added are noted as such.
Graphics may not represented as your own in any form.
Graphics may not be used in any obscene or unethical manner.
Purchase and/or download of any WinksArt Graphic Graphic[s] indicates agreement to these terms.
Personal Use:
Purchasers are permitted to use these Graphics for personal use only by a single user or single family household for personal projects. Any other use requires the prior written consent of the artist[s].
Professional or Commercial Use:
Graphics which are specifically designated for commercial use, and which are accompanied by a commercial use license, may be used, copied and modified by the individual purchaser for her/his own small business use as follows:
* Purchaser may design derivative work that they will personally sell or profit from as a result of their design work using the licensed Graphics.
* Purchaser may design work for outside companies by which he/she is not permanently employed, as long as the company will not profit from the work for which the Graphic[s] is/are used.
* Purchaser may not turn the derivative designs over to any company permanently for any reason.
*Purchaser may not use the Graphics for design work that will be turned over to another company or individual with the intention that the other company or individual will profit from the derivative work.
* Graphics may not represented as your own in any form.
* Graphics may not be used in any obscene or unethical manner.
WinksArt Graphics commercial use products, which are to be considered a design tool rather than a final design product, are licensed to the purchaser's computer only and are not to be shared, loaned, rented, resold, distributed, transferred, or posted in any way or by any means in their original form.
The purchaser of commercial use Graphics has a license to create derivative designs using these Graphics. License is not granted to the Purchaser to re-distribute them in their original format, or to present them as his/her own design.
